5. PRECEDENCE AND SUCCESSION:
This Agreement shall supersede, replace, and take precedence over any prior terms and conditions or terms and conditions of similar character. All rights, obligations and liabilities herein given to, or imposed upon the respective parties hereto shall extend to and bind the several respective heirs, executors, administrators, successors, and assigns of said parties. This Agreement shall not be construed against the drafter.
6. GOVERNING LAW:
You agree that this Agreement is governed by and shall be construed under and pursuant to the laws of the State of Florida and the United States of America, without regard to conflict of law requirements of any state. You agree to submit to the jurisdiction of the Courts of Florida. Specifically, you agree that any claim brought pursuant to this Agreement shall be brought only in a Court of competent jurisdiction in Broward County, Florida.
7. SEVERABILITY:
If any term or condition or the application thereof is held to be invalid by a court of competent jurisdiction, then such term or condition shall be severed herefrom, and such invalidity shall not affect any other term or condition, the balance of which shall remain in and have its intended full force and effect.
8. WAIVER:
None of the requirements of the Agreement shall be considered as waived by either party unless the same is done in writing, and then only by persons executing this Agreement or other duly authorized agents or representatives. The waiver by either party of a breach or a violation of any provisions of this Agreement shall not operate as or be construed to be a waiver of any subsequent breach or violation.
9. ATTORNEY’S FEES:
You agree to reimburse Foreclosure Self-Defense, LLC for all costs and expenses (including a reasonable attorney’s fees) incurred by Foreclosure Self-Defense, LLC in its efforts to enforce your obligations or those of your representatives or agents, as stated in this Agreement. In any litigation that may arise as a result of this Agreement, the prevailing party shall be entitled to recover a reasonable attorney’s fee and costs (including any and all appeals).
10. ENTIRETY:
You expressly understand and agree that all of the terms and conditions of this Agreement are incorporated herein and no oral agreements, understandings, or agreements of any kind or character inconsistent herewith have been or are hereby entered into. This Agreement represents the final terms and conditions and no agreements or representations (oral or otherwise) unless incorporated into these terms and conditions shall be binding. Any pronoun shall be read in the singular or plural and in such gender as the context may require.
11. COPYRIGHTS:
Any copying, reproduction, distribution, dissemination, sharing, or unauthorized use of the information, documents, or materials that can be obtained through this website is strictly forbidden and may be in violation of copyright laws.
