In any litigation that may arise as a result of this Agreement, the prevailing party shall be entitled to recover a reasonable attorney’s fee and costs (including any and all appeals). 10. ENTIRETY: You expressly understand and agree that all of the terms and conditions of this Agreement are incorporated herein and no oral agreements, understandings, or agreements of any kind or character inconsistent herewith have been or are hereby entered into. This Agreement represents the final terms and conditions and no agreements or representations (oral or otherwise) unless incorporated into these terms and conditions shall be binding. Any pronoun shall be read in the singular or plural and in such gender as the context may require. 11.
